Terms of Service

1. The free entertainment service

VividSunsets offers sunrise and sunset artwork, stories, archive browsing, and prepared wallpaper downloads. You can read, browse, and download individual wallpapers without an account, payment, or newsletter subscription. Optional accounts help keep favorites across devices. We do not currently offer purchases or paid subscriptions through the Service; any future paid offer would require separate, clearly disclosed terms and your affirmative purchase decision.

For entertainment purposes only. All artwork is AI-generated and inspired by real places. It is an artistic interpretation, not a photograph, live camera, or record of actual weather, geography, access conditions, or events. Stories are creative works and may be written with AI assistance. Characters, dialogue, and events are fictional unless expressly identified otherwise; real place names do not make a story factual reporting. Content is not medical, mental-health, legal, financial, travel-safety, or other professional advice. No particular emotional or wellness result is promised.

The sunrise and sunset labels describe our collections. Their automatic changes use your device's local time: sunrise starts at 4 am; sunset starts at 4 pm and continues until 4 am. These are product times, not astronomical forecasts. Artwork repeats within independent collections; a new visit does not generate new imagery or guarantee new content.

2. Eligibility and accounts

You must be at least 13, or the higher minimum age required by applicable law, to use the Service. If you are below the age of legal adulthood where you live, use it only with a parent or guardian's permission and supervision; that adult must review these Terms with you.

If you choose an account, provide accurate information, use an email address you control, keep your password confidential, and tell us promptly if you suspect unauthorized access. You are responsible for activity you authorize and for reasonable care of your credentials. Do not impersonate someone else or use another person's account without permission. We do not ask you to email us your password.

3. Artwork, stories, and download permissions

To the extent we hold the relevant rights, we grant you a free, nonexclusive, worldwide permission to access and read the content for personal, noncommercial enjoyment and to download, store, display, and crop our offered wallpapers for your personal devices. You may keep personal copies already downloaded in accordance with these Terms. Attribution is not required for private wallpaper use.

You may share links to our artwork and story pages and send an offered wallpaper privately to friends or family for their personal use. Please include a VividSunsets link when sharing a file. Public reposting of full stories, bulk redistribution, resale, stock-image listings, merchandise, commercial advertising, or offering our files as a competing download collection requires our written permission to the extent our rights are involved. Contact us about uses outside this permission.

The Service's branding, original prose, design, software, and any protectable selection, editing, or arrangement remain subject to their respective intellectual-property rights. Downloading does not transfer ownership or grant rights in our trademarks. AI-generated material may have limited or no copyright protection under applicable law; we do not claim exclusive copyright in material that is not legally protectable. These Terms do not restrict public-domain material, fair use, or other rights the law gives you. We cannot grant third-party trademark, publicity, privacy, or other rights that we do not hold.

Files may contain invisible AI provenance signals, including SynthID where supplied by the generation provider. A clean wallpaper means the offered image has no website controls or visible promotional overlay; it does not promise the absence of invisible provenance or establish photographic authenticity.

If you believe content infringes your rights, email legal@vividsunsets.com with the exact page/file URL, the work or right involved, your contact details, and an explanation of your authority and concern. We will review appropriate reports and may remove or restrict disputed material. Do not send knowingly false notices.

4. Acceptable use

Use the Service lawfully and with respect for others. You must not:

• Bypass access restrictions or rate limits, attack the Service, introduce malicious code, probe other people's accounts, or interfere with availability or security.
• Use automated bulk downloading or extraction that overloads the Service, circumvents safeguards, or infringes applicable rights. Ordinary search-engine indexing consistent with our published crawling instructions is permitted.
• Use our sharing tools to send spam, harassment, unlawful messages, or deceptive promotions, or submit another person's email without authorization.
• Misrepresent our AI artwork as documentary photography or a verified account of real conditions, impersonate VividSunsets, or falsely imply our endorsement.
• Use content in a way that violates applicable law or another person's intellectual-property, privacy, or publicity rights.

The Service does not provide a public visitor-upload or commenting feature. If you send feedback, you allow us to use the suggestions to improve the Service without an obligation to pay you; that permission does not transfer ownership of unrelated work or override our Privacy Policy.

5. Sharing, email, and other services

The email share form records the sender address and opens a draft in your own email app. You select recipients there, and you decide whether to send. We do not receive recipient details through this feature and do not guarantee message delivery. Device sharing and saving destinations are controlled by your browser and operating system; opening a share sheet does not prove a file was saved.

The optional newsletter requires a separate opt-in and email confirmation. It is intended to contain a monthly story, exclusive wallpaper, and partner offer. You may unsubscribe through its link or contact us. Account and recovery emails are separate from marketing. Promotional or partner content does not mean we guarantee a third party's products or services.

The Service uses providers including Cloudflare, Supabase, and Brevo. Links may lead to independent websites, whose terms and privacy practices apply there. We are responsible for our own legal obligations, but do not control your email app, device software, external sites, or independent partner services.

6. Privacy

Our Privacy Policy explains browser and account identifiers, favorites, sharing records, newsletter choices, providers, email tracking, retention, and your request options. Agreeing to these Terms does not enroll you in marketing or replace any consent required by law.

7. Availability and ending use

We may update, replace, withdraw, or discontinue content or features, or temporarily limit access for maintenance, security, legal requirements, or reasonable operational needs. We may suspend or close accounts for material violations of these Terms or risks to the Service or others. Where reasonably practicable and legally appropriate, we will provide notice and a chance to address an issue; urgent protective action may be immediate.

You can stop using the Service at any time and request account closure at legal@vividsunsets.com. Closure and data retention are handled as described in the Privacy Policy. Keep your own copies of downloaded files and information you want to retain. Ending access does not remove liability for earlier conduct or rights and obligations intended to continue, including lawful personal-copy permissions, applicable intellectual-property provisions, and dispute provisions.

8. Disclaimers

To the extent permitted by law, we provide the Service and content "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free availability, factual or geographic accuracy, compatibility with every device, permanent storage of favorites, a particular display or save result, or that AI outputs are unique or free of third-party claims.

These disclaimers do not limit any warranty, quality standard, remedy, or other right that applicable law does not allow us to exclude.

9. Limits of liability

To the extent permitted by applicable law, Vivid Sunsets LLC and its personnel will not be liable for indirect, incidental, special, consequential, or punitive losses arising from the Service, including lost profits, lost business opportunities, or loss of data, even if advised of the possibility. This exclusion applies only where the law permits and does not remove liability for direct losses for which we are legally responsible.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability or consumer right that cannot lawfully be excluded or limited. If the law where you live provides stronger protections, those protections apply.

10. Law and disputes

These Terms are governed by the laws of North Carolina, United States, excluding its conflict-of-laws rules, except that mandatory consumer protections in your place of residence continue to apply. Please contact legal@vividsunsets.com to try to resolve a concern. Doing so does not prevent you from seeking urgent relief or exercising your legal rights.

Unless mandatory law gives you the right to bring a claim elsewhere, disputes may be brought in the state or federal courts with jurisdiction in North Carolina. Nothing in these Terms deprives a consumer of a mandatory right to use the courts where they live.

11. Changes to these Terms

We may revise these Terms as the Service or legal requirements change. We will update this page and its effective date. For material changes, we will provide reasonable advance notice through a prominent website notice or another appropriate channel, except where urgent security or legal reasons require a faster change. Changes apply prospectively. Continued use after the stated effective date signifies acceptance to the extent permitted by law; where express agreement is legally required, we will request it.

12. General terms and contact

If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. These Terms and any clearly identified terms for a particular feature govern your use of the Service; they do not override mandatory legal rights. No third party is intended to receive enforcement rights under these Terms.
